DI 71005.010 Border Field Office (FO) and Disability Determination Services (DDS) Process for Reconsideration Requests Mexican Residents File in the United States

A. Border FO reconsideration claim procedures

The border FO accepts reconsideration requests on initial disability determinations Mexican residents file in the United States and completes the following steps for medical or non-medical denials.

1. Medical denials

Forward the request directly to the DDS according to normal procedures found in DI 27000.000.

2. Non-medical denials

a. FO affirms initial determination

If the FO affirms the initial determination, transfer the claim to the Office of International Operations after adjudication.

b. RO reverses initial determination

If the FO reverses the initial determination, transfer the claim to the DDS for an initial medical determination, according to the instructions in DI 81010.145.

B. Procedures for DDS reconsideration claims

Process reconsideration claims filed by residents of Mexico following normal adjudication procedures found in DI 27000.000. Where applicable, the procedures described in DI 71005.005 may also apply at the reconsideration level.

NOTE: Unit 22 of the Texas DDS handles all reconsideration claims filed in Texas by Mexican residents.
