SI 01310.685 SSA-8010-BK - Sponsor of Alien - Questions 13-16
We need information about sponsorship of an alien when the person making the statement is:
The sponsor of an alien and completes the SSA-8010-BK on behalf of the alien; or
An ineligible parent and completes the SSA-8010-BK on behalf of his/ her child, and also sponsors an alien who is eligible for SSI benefits.
The information is used to determine the proper allocation (dependent allocation for sponsor-to-alien deeming or eligible alien allocation for parent-to-child deeming).
B. Procedure — question 13
Complete for all deemors. If the answer is “Yes” and the person making the statement is:
the sponsor of an alien reporting his/her income and resources on behalf of that alien, then go to question 14.
an ineligible parent reporting his/her income and resources on behalf of his/her eligible child, then go to question 16.
If the answer is “No,” then go to item 17 (Signature).
C. Procedure — question 14
Complete 14(a). List the sponsor's dependents in 14(b) if (a) is “Yes.” If the sponsor alleges no dependents, go to question 15.
If the dependent is also an SSI claimant/recipient, consider the need to update other cases in multiple alien deeming situations.
D. Procedure — question 15
Complete question 15 for individuals who answer question 14.
Emphasize question 15 because it acknowledges a sponsor's liability for any overpayment made to an alien that results from the sponsor's failure to provide correct information regarding deemable income and resources.
Explain that payment cannot be made to the claimant/recipient without the sponsor's agreement to report changes.
E. Procedure — question 16
Ask a parent who answered “Yes” to question 13 to provide the information requested about each alien he/she sponsors.
Use this information to determine if an eligible alien allocation applies in the parent-to-child deeming computation.
