HI 00401.215 Termination of Provider Participation

A provider may voluntarily terminate its participation in the program or have it terminated by the Secretary for cause.

A. Voluntary termination

MINOR CHANGEA provider may terminate its agreement by filing a written notice with the Medicare regional office. CMS may accept the termination date stated in the notice (the date must be the first day of a month) or set a different date. However, the termination date set by the Administration shall not be more than 6 months from the date the provider’s notice is filed.

B. Involuntary termination

CMS may terminate an agreement with a provider if it determines that the provider:

  1. 1. 

    Is not complying substantially with the provisions of the agreement or with the applicable provisions of title XVIII of the Act and regulations; or

  2. 2. 

    No longer meets the appropriate conditions of participation; or

  3. 3. 

    Has failed to supply information which is necessary to determine whether payments are due or were due and the amounts of such payments; or

  4. 4. 

    Refuses to permit examination of fiscal and other records.
