NL 00760.300 Types of Garnishment Notices

Description of Possible Types of Garnishment Notices

The table below provides descriptions for the possible types of Garnishment notices.

 

1. Type 1 Notice – Garnishment Started

A Type 1 notice will be generated whenever garnishment is started and the beneficiary is in pay status

A Type 1 notice requires a notice to both the beneficiary and court

2. Type 2 Notice – Change Affects Garnishment

A Type 2 notice will be generated whenever the garnishment amount is being changed for any reason.

A Type 2 notice requires a notice to both the beneficiary and court.

3. Type 3 Notice – Garnishment Stopped

A Type 3 notice will be generated when the garnishment is stopped for the following reason:

  • Stop Order is received from the court

A Type 3 notice requires a notice to both the beneficiary and court.

4. Type 4 Notice – Beneficiary Protests Garnishment

A Type 4 notice will be generated if the beneficiary protests the Garnishment

A Type 4 notice will only be sent to the beneficiary.

5. Type 5 Notice – Initial Reject - Bene Not in Pay

A Type 5 notice will be generated whenever the Garnishment order is initially rejected because the beneficiary is not in pay status.

A Type 5 notice will only be sent to the court.

6. Type 6 Notice – Claim Pending

A Type 6 notice will be generated whenever the Garnishment order is received and the claim is pending

A Type 6 notice will only be sent to the court.

7. Type 7 Notice – Garnishment Suspended – Court Ordered Suspension

A Type 7 notice will be generated whenever the Garnishment is suspended

A Type 7 notice requires a notice to both the beneficiary and court.

8. Type 8 Notice – Garnishment Resumed – Court Ordered Resumption

A Type 8 notice will be generated whenever the Garnishment is resumed after a suspension.

A Type 8 notice requires a notice to both the beneficiary and court.

9. Type 10 Notice – Garnishment Order Pending More Than 12 months

A Type 10 notice will be generated whenever a Garnishment Order has been pending on the database for 12 months or more

A Type 10 notice will only be sent to the court.

10. Type 11 Notice – Prior Monthly Accrual (PMA) Issued for the Garnisher

A Type 11 notice will be generated whenever we are releasing a lump sum to the garnisher.

A Type 11 notice will only be sent to the beneficiary.

11. Type 12 Notice – PMA Issued for the Garnisher

A Type 12 notice will be generated whenever we are releasing back pay owed to the garnisher.

A Type 12 notice will only be sent to the court.
