   Questions have been raised about the proper application of the continuing employment
      exception and the continuation of coverage rules when dealing with the Medicare (HI-only)
      divided referendum vote of a State employee who transfers between agencies and entities
      within the State government system. There is a similar concern for the divided Medicare
      (HI-only) referendum vote of a political subdivision employee who transfers between
      agencies and entities of the same political subdivision.
   
   
      
   
   SL 30001.380D. is being added to provide hypothetical situations (scenarios) which illustrate the
      process that should be used to properly determine how an employee's Medicare (HI-only)
      referendum vote will be treated when he/she transfers from one government entity to
      another within the same government system or between entities of two different government
      systems (e.g., State government <--> political subdivision, political subdivision

         Scenarios
   
   This subsection provides six hypothetical scenarios involving State and local government
      employees who transfer positions between governmental entities within the same government
      system or who transfer positions between governmental entities of different government
      systems. Also presented are the four factors that must be considered when determining
      whether an employee's Medicare (HI-only) divided referendum vote carries over to the
      new position.
