This is a Quick Action Transmittal. These revisions do not change or introduce new policy or procedure.

Summary of Changes

DI 30005.405 Second Returns

This transmittal is part of an ongoing activity by the Office of Quality Review to update POMS. This update does not change policy.

We made the following revisions to all sections:

  • Followed plain language guidelines;

  • Made minor changes to clarify content;

  • Shortened sentences, where possible.

DI 30005.405 Second Returns

A. Policy

If the review component disagrees with the corrective actions taken by the adjudicating component and the adjudicating component does not rebut the deficiency, the review component will either assume jurisdiction, take the necessary corrective action, and prepare a new disability determination; or prepare a new SSA-1774-U5 (Request for Corrective Action) and return the case to the adjudicating component. The review component will not change the code for the original deficiency nor cite an additional deficiency. The reason for the second return will be explained on the SSA-1774-U5 or SSA-847-U3 (Request for Case Action) used to transmit the case.

See GN 04440.203 for a further explanation of review component action in second return situations.

B. DDS procedure

If the review component returns the case a second time, complete the requested corrective action and return the case to the review component.
