This is a Quick Action Transmittal. These revisions do not change or introduce new policy or procedure. The requested action only removed duplicative language.
Summary of Changes
DI 24598.003 Low Birth Weight (LBW)
We replaced the words "gestational age" with the acronym "GA", and removed "because the small for GA" as this language appears earlier in the sentence.
In listing sections 100.04A and 100.04B, birth weight is the first weight recorded after birth.
LBW is a birth weight:
less than 1200 grams; or
2000 grams or less and small for gestational age (less than the 3rd percentile).
GA is the infant's age based on the date of conception as recorded in the medical record. GA may be:
expressed in terms of the time elapsed from the first day of the last menstrual period of the mother; or
calculated based on certain physical signs at birth using scoring systems designed for this purpose, such as the Dubowitz forms for assessment.
If there is a significant discrepancy between the GA calculated using these two methods, the age determined based on the physical signs is usually more accurate.
LBW is not an MDI:
for infants whose birth weight is more than 2000 grams
for children over age 1
LBW is an MDI for infants from birth to the attainment of age 1 whose birth weight is 2000 grams or less.
Note: While many LBW infants are born prematurely, prematurity is not a prerequisite for the establishment of an MDI of LBW.
Establish LBW when we have the following documentation recording a qualifying birth weight:
an original or certified copy of the infant’s birth certificate; or
a medical record signed by an acceptable medical source.
Evaluate LBW under listing 100.04 in infants from birth to attainment of age l. If the infant's MDI meets the requirements for 100.04A and 100.04B, see DI 25235.006 Medical Diary Criteria for Low Birth Weight (LBW) Infants under Title XVI.
Note: Values in the table in 100.04B represent the weight considered small for GA (that is, less than the 3rd percentile). The table does not include a value for GAs below 31 weeks because the small for GA value for 31 weeks or below is less than 1200 grams, which is the criterion in 100.04A. The table also does not include values for GAs above 40 weeks because the small for GA value is above 2000 grams, which is the maximum birth weight considered under 100.04B.
The table in listing 100.04B does not describe GA in weeks and days; therefore, a GA in weeks and days, and an accompanying birth weight that is less than the 3rd percentile for that GA, is a finding of equivalent severity and duration to the listing requirement, which means the impairment medically equals the listing.
