A. Purpose

This Emergency Message (EM) provides updated guidance when the Office of Benefit Accounting and Systems Analysis (OBASA) forwards the Title XVI FMS-133 NOR to the field office (FO).

B. Background

The FMS-133 Notice of Reclamations (NOR) is used to notify Social Security Administration (SSA) of recipient payments returned to the Department of the Treasury (Treasury) as a result of a reclamation request. The FMS-133 NOR also provides SSA with the information needed to contact the last withdrawer when all of the funds paid after death are unrecoverable by the financial institution (FI).

When an individual receiving Social Security Title II or Supplemental Security Income Title XVI benefit payments dies, and his or her payments are issued through direct deposit, we attempt to recover payments issued after death directly from the FI. This process, called reclamation, allows Federal Agencies to “reclaim” payments made when payment was not due.

For Title XVI, a payment for any month later than the month of death is not due to the recipient and must be reclaimed.

C. Prior Process for Forwarding Title XVI FMS-133 NOR


    o Treasury uploads the FMS-133 NOR form into the Treasury Check Information System (TCIS) for an electronic copy to be available for retrieval by OBASA.
    o OBASA reviews the FMS-133 NOR retrieved from TCIS and analyzes the Supplemental Security Record (SSR).
    o OBASA emails the FMS-133 NOR file along with the standard message to the field office (FO) jurisdiction to contact the last withdrawer:

    Attached is an FMS-133 Notice of Reclamation from the Department of the Treasury containing last withdrawer information provided by the relevant Financial Institution regarding a Title XVI reclamation case. Per Section C of POMS GN 02408.630 SSA Contacts Last Withdrawers, the Office of Benefit Accounting and Systems Analysis (OBASA) is providing the last withdrawer information for your necessary action.     o The FO uploads the necessary information into WorkTrack to be assigned to a technician for processing.

D. New Process for Forwarding Title TXVI FMS-133 NOR
    o Treasury uploads the FMS-133 NOR form into TCIS for an electronic copy to be available for retrieval by OBASA.
    o OBASA will review the FMS-133 NOR retrieved from TCIS and analyze the SSR.
    o OBASA will use DOORS to locate the office WorkTrack fax number (Phone Type: Business). NOTE: Do not use the admin fax number.

      o OBASA will use the Desktop Faxing solution to e-Fax the FMS-133 NOR, allowing a direct upload into WorkTrack for profiling and assignment to a technician to work the case. NOTE: FOs must use ‘TREASURY – Treasury Doc’ as a form type in WorkTrack when profiling.
      o Once assigned, technicians should continue to follow current procedures in GN 02408.630 for processing the FMS-133 NOR. IMPORTANT: Since this type of case usually involves overpayments, FO technicians will store the form in NDRed or eView for reference in case the last withdrawers files for a reconsideration or a waiver.
      Direct all program-related and technical questions to your RO support staff. RO support staff may refer questions or problems to their Central Office contacts.
