Background

We published a final rule on August 21, 2024. The regulation establishes a process for representatives to assign direct payment of fees to entities and the mandatory use of the form SSA-1696. The changes implemented in this section are part of several changes to our subregulatory guidance in accordance with the First Circuit Court decision in Marasco & Nesselbush, LLP v. Tara Collins and Social Security Administration. These notices are necessary to inform entities and their POCs of our process.

GN 03905.016 Registration of an Entity Notices

This is a new section with two notices for entity registration.

Notice RSR101- Notification of Successful Registration to Entity will be released through RASR.

MAO102 – Notification of Failed Registration to Entity. This is a template for a notice that must be released manually.

A. When to use

Appointed representatives have the option to assign the right to direct payment of their authorized fees to entities. The entities must register to be eligible for direct payment. The notices in this section are for successful or unsuccessful registration.

B. Exhibits

 

1. RSR121 – Notification of Successful Registration to Entity 

This notice will be available through RASR.

We received and successfully processed registration Form SSA-1694, Entity Registration and Taxpayer Information, for [Entity Name]’s [Entity EIN]. As requested, the tax mailing address we will use for [Entity Name] is

It is important to keep all information, including the point of contact’s and the entity’s details, up to date. Use Form SSA-1694 to update [Entity name]'s information.

2. MAO102 – Notification of Failed Registration to Entity

This notice must be created manually.

We received your submission of Form SSA-1694, Entity Registration and Taxpayer Information, but we are unable to process it because it is incomplete and/or contains incorrect information. In order for us to process Form SSA-1694, you must submit a complete, current version of Form SSA-1694. The current version of this form is available online in PDF format at https://www.ssa.gov/forms/ssa-1694.pdf. Please submit a new, current form and follow the instructions closely to make sure you accurately complete all sections you are required to complete. Provide all information requested in these sections, including signatures, unless the form specifically labels the item as optional.
