December 31, 2026 - A State may establish Medicaid eligibility for the recipient as early as the first day of the third month preceding the month an application for SSI payments or SSPs is effectively filed if the individual is determined eligible for SSI or SSP and would have met Medicaid eligibility criteria during the retroactive period. The three calendar months can be in addition to any days subject to proration.
Rules January 1, 2027 and after - As required by section 71112 of P.L. 119-21, effective January 1, 2027, the retroactive eligibility period for individuals determined eligible for SSI or SSP, and who would have met Medicaid eligibility criteria during the retroactive period, will be limited to two months prior to the month of application.
