Background
The two POMS sections precede the establishment of Age-18 Redetermination policy and provide instructions to process CDR cases where Title XVI recipients attained age 18 before August 22, 1996, and the SSI determination from the most recent favorable decision contained an Individualized Functional Assessment (IFA) or consideration of maladaptive behaviors.
The content in DI 28005.016 and DI 28005.017 is archived. Nearly three decades have passed since public law established Age-18 redeterminations, and cases involving IFAs have since aged out of the preceding instructions through CDRs that would have occurred over that time span. The archival of these instructions is consistent with efforts to fulfill the requirements of Executive Order 14192, Unleashing Prosperity Through Deregulation.
