A. Purpose
This emergency message (EM) informs you of immediate and temporary changes in the “Failure to Provide Information” N20 workload.


B. Background
Current instructions in SI 02301.235 (Failure to Provide Information (N20)) require field office (FO) staff to obtain approval from management to apply an N20 suspension. After obtaining approval, FO staff may input the N20 suspension. We are currently revising the instructions to clarify the procedures for applying an N20 suspension. Under the revised instructions, only management (a Management Support Specialist (MSS) or higher) will be able to input N20 suspensions. The revisions will be supported by an enhanced solution that will restrict N20 suspension inputs to FO management only. This solution will be developed separately from the POMS instructions, with a targeted implementation date in FY22.

C. Procedure

While we await the enhancement to restrict N20 suspension inputs to FO management only, defer making a determination that a recipient is ineligible due to failure to provide information and do not use PSY N20 to suspend Supplemental Security Income (SSI) payments. If at any time the recipient subsequently complies with previous requests for information, resume normal processing of the pending action under existing procedures.

The hold on N20 suspension inputs is effective immediately and will remain in place until further notice.


    1. Redeterminations (RZ) or other post-eligibility issues

    Follow existing procedures in SI 02301.235 to develop and document all attempts to obtain the required information. Technicians must ensure they have exhausted all efforts to obtain the information and use alternative dispositions (e.g., payment status S06, S08, N05 and N19) only when applicable and appropriate. Additionally, they must document these efforts on a DROC Report of Contact or Form SSA-5002 for non-MSSICS cases.

        a. Document the case with:
            • MSSICS DW01

                o Change the last three digits of the unit code to ‘N20’ (i.e., XXXN20).

                o Add an ‘N20SUSP’ issue with a tickle date of 03/05/2022.


              NOTE: For non-MSSICS cases, establish an MDW.
            • Add the following special remark to the SSR:

              “Failure to provide evidence for (select RZ/CDR/PE)//Eligibility determination and N20 suspension deferred per EM-21079”

    IMPORTANT: If the issue remains unresolved, do not change the unit code, receipt in, or change the tickle date until the agency lifts the moratorium.

    NOTE: If desired, local management may establish a log of all cases held during the moratorium to assist with locating cases once the moratorium has been lifted.

    CAUTION: Do not close or clear the open redetermination while the case is held under this moratorium.

    2. Continuing Disability Review (CDR)

        a. Title XVI cases
            • Follow instructions in C.1. above develop and document all requirements to obtain the necessary information to conduct the medical CDR.
            • Document failure to cooperate on a DROC or SSA-5002 for non-MSSICS cases per DI 13015.250.
            • Document the case with:

                o MSSICS DW01
                    § Change the last three digits of the unit code to ‘N20’ (i.e., XXXN20)

                    § Add an ‘N20SUSP’ issue with a tickle date of 03/05/2022

                o Add the following special remark to the SSR:

                o “Failure to provide evidence for (select RZ/CDR/PE)// N20 suspension cannot be applied – moratorium in effect”

        b. Concurrent cases

          Defer any decision on Title XVI eligibility and Title II entitlement based on failure to provide information. Do not suspend benefits for either Title to avoid payment issues resulting from suspended Title II benefits while SSI remains in pay. For the portion of the CDR case involving:
            • Title XVI, follow processing instructions in C.2.a. above.
            • Title II, follow existing development and documentation requirements to obtain the necessary information to conduct the medical CDR.
            • DCF Worksheet
                o Change the last three digits of the unit code to ‘S0’ (i.e., XXXS0).
                o Add an ‘S0SUSP’ issue with a tickle date of 03/05/2022.

                o Do not suspend payments using ‘S0’.

      IMPORTANT: If the issue remains unresolved, do not change the unit code, receipt in, or change the tickle date until the agency lifts the moratorium.

      NOTE: If desired, local management may establish a log of all cases held during the moratorium to assist with locating cases once the moratorium has been lifted.

      CAUTION: Do not take action in the DCF to clear the CDR or post an FTC decision while the case is held under this moratorium.

D. Resumption

This moratorium will remain in place until further notice. However, once the enhanced solution is implemented, we will archive this EM and you may follow revised instructions in SI 02301.235.
