DI 28003.010 Deferrals of Continuing Disability Review (CDR) Process

A. Agency responsibility when processing a CDR deferral

The Agency's policy is to complete a CDR on every case. A CDR may be deferred if it falls into one of the following categories:

  1. 1. 

    Short-term deferral: Reasons unrelated to the disability, for example, weather, travel, hospitalization (short duration); or

  2. 2. 

    Long-term deferral: Suicidal or homicidal situations (with Disability Program Administrator (DPA) approval), see DI 13005.070 and DI 28040.100D.

If the case meets one of these categories to defer the CDR, the Disability Determination Services (DDS) must follow the procedures in this section.

NOTE: If development of the CDR can be completed within 2 months, the DDS should not defer the CDR and retain the folder until CDR completion. After completing the determination, the DDS must send the case back to the field office (FO) as mentioned DI 81020.250B. If the case involves a Title II prisoner, see DI 28065.000.

B. DDS responsibility when processing a CDR deferral back to the FO

The DDS must defer the processing of the CDR when the case meets one of the deferral categories in section A.

Prior to deferral of a case for hospitalization for a new impairment, see DI 28005.210.

The DDS must contact their DPA on other situations that may require deferral.

The DDS must process a CDR that meets the deferral criteria as a "No Determination" (ND). Prior to sending the case back to the FO, the DDS must complete the following actions.

  1. 1. 

    In the Certified Electronic Folder (CEF), add an SSA-5002 (Report of Contact) as mentioned in DI 23030.005 with the following remark:

    1. a. 

      “Deferral for reasons unrelated to the disability on (date); not to exceed 6 months. Due to deferral of determination; this is not the CPD.”; or

    2. b. 

      “Deferral for life-threatening situation DPA approval received on (date); not to exceed 6 months. Due to deferral of determination; this is not the CPD.”

      NOTE: 

      In cases that are deferred for a life-threatening situation, the DDS must add a Special-H flag or Special-S flag, as mentioned in DI 81010.080 into the CEF. The flag will be displayed in eView; back to the FO with the following remark “Deferral for life-threatening situation, DPA approval received on (date)” see DI 81020.085.

  2. 2. 

    In the Disability Case Processing System (DCPS), close the case an ND (FO Determination Requested (FODR). The DDS must use the guidance to return the case back to the FO, see DI 81020.127.
