GN 01728.015 How the FSP Processes and Develops Claims Filed with a Portuguese Agency

A. Introduction

When a claim for U.S. benefits is filed with a Portuguese agency, that agency routes a liaison Form P/USA 3 to the FSP, along with the Portuguese coverage record (Form P/USA 5).

B. Procedure

Follow the procedures below which explain how the FSP should process referrals from the Portuguese agency.

1. Claimant is Eligible for U.S. Benefits

  • If the claimant meets the age and QC requirements for U.S. benefits, obtain Form SSA-2490-F4 (Part I) and the appropriate RSDI applications and evidence, OR obtain a signed statement that the claimant does not want to file a claim.

  • Forward claims to CDB in OIO with the liaison Form P/USA 3 and the Portuguese coverage certification (P/USA 5).

    If the Portuguese agency has requested information from OIO on Form P/ USA 3, attach a flag to the material with the following information:

    The Portuguese agency has requested information on this case. After award or disallowance action, forward the folder to a liaison clerk in the totalization modules.

  • Forward a signed statement to the totalization modules in OIO if the claimant does not want to file a claim.

2. Claimant is not Eligible for U.S. Benefits

  • If the claimant is clearly not eligible for U.S. benefits or is already entitled, no claims development action is necessary.

  • If the Portuguese agency has requested information, forward Forms P/ USA 3 and P/USA 5 to the totalization modules in OIO. If no information was requested, destroy the Portuguese agency forms.
