RS 00615.761 Computing Retroactive Benefit of Late Applicant - Maximum Involved

A. POLICY

When a late filing auxiliary or survivor becomes entitled, any benefit already certified or paid to an existing beneficiary will not be reduced for any month prior to the month the late filer filed their claim. See RS 00615.760 and RS 00203.055.

B. GLOSSARY

1. Certification Date

The certification date is the date shown in the "run date" block of the computer output.

2. Retroactive Period

The retroactive period includes all months of entitlement prior to the date the claim was filed.

C. PROCEDURE

To determine the amount payable to the late filer:

  • Total the amount of all benefits that would have been paid to the auxiliaries or survivors in the retroactive period if the late filer had been on the rolls.

  • Subtract the benefits that were actually paid to the previously entitled auxiliaries/ survivors. (For reduced spouse’s benefits, refer to RS 00615.210.)

  • Pay any remainder to the late filer.
