An employable person shall not be eligible for APTD. Employability shall be determined
by MRT from social and occupational data submitted by the county eligibility worker
in conjunction with medical examination evidence as related to the person's occupational
history and current physical and/or mental condition.
-
a.
Homemaker: If a woman's primary or only occupation has been that of a homemaker she will be
considered employable if she can perform the daily functions of maintaining a home
for herself and her family. A person living alone will not be evaluated as a homemaker.
-
b.
Other Occupations: Persons with a history of paid employment in competitive occupational
settings (i.e., exclusive of sheltered workshop or rehabilitation type work projects)
will be considered employable if they are working or are capable of working twenty
(20) or more hours per week in such settings regardless of the availability of such
employment. Such persons who are working less than twenty (20) hours per week because
of the lack of employment will also be considered employable.
NOTE: Persons who are only capable of performing work in a sheltered workshop setting or
rehabilitation work project are considered unemployable for purposes of this section
since they cannot compete in the normal labor market.

c.
Rehabilitation Training: An APTD recipient may be enrolled in a rehabilitation program which includes paid
employment or job training provided that such program is conducted under the auspices
of a bona fide rehabilitation agency, is of a specified time duration, and the income
does not exceed the recipient's need after appropriate income disregards are applied.
(See 3-1121.4C)
Recipients who, without good cause, refuse referral to DVR or other authorized rehabilitation
agency or fail to comply with rehabilitation policy shall be ineligible for APTD.
Determination of “good cause” shall be made in conformity with A.P. Manual Section 3-407.5B.
