SI 01110.530 Whose Resources to Consider

A. Introduction

In addition to resources that actually belong to an eligible (or would-be eligible) individual, the SSI statute provides that the resources of certain other persons are considered to be available to the individual. Therefore, all appropriate resources determinations include those other persons' resources.

B. Policy

1. Spouse of Adult Individual

The resources of an individual include those of a spouse, and the applicable resource limit is that for a couple, provided that the spouse:

  • if eligible, lives in the same household as the individual as of the first moment of the month for which resources are being determined (prior to October 1, 1990, if eligible,  had not been separated from the individual for more than 6 full calendar months).

  • if ineligible, lives in the same household as the individual as of the first moment of the month for which resources are being determined.

SI 00501.154 contains policy that applies when the members of a couple separate in the month for which resources are being determined, as well as additional considerations pertaining to couple status.

2. Parent(s) of Child Under Age 18

The resources of an individual who is a child under the age of 18 include those of their ineligible parent(s) or spouse of parent(s).

SI 01330.200 ff. contains policy and procedures concerning parent-to-child deeming. The applicable resources limit for a child is always that for an individual.

3. Essential person of qualified individual

The resources of a qualified individual include those of their essential person(s). The applicable resources limit depends solely on whether or not the qualified individual has a spouse. See SI 00501.100 for qualified individuals and essential persons and SI 01330.420 on deeming resources from an essential person.

4. Sponsor of an alien

For 3 years following an alien's admission into the U.S. for permanent residence, the alien's resources may include those of their sponsor and of the sponsor's spouse. The applicable resources limit depends solely on whether or not the alien has a spouse. See SI 01330.500 through SI 01330.550 on deeming resources from a sponsor.
