RM 03803.009 Determining the Claim or Non Claim Status of a Record

  1. A. 

    Consider the record to be in “claims” status where:

    1. 1. 

      Earnings record information on the MEF/SSA-1826 printout indicates a claim.

      NOTE: Any symbol in the “DS” or “CS” space on the SSA-1826 should be considered a claim.

    2. 2. 

      The case material indicates that the NH has filed for a benefit based on his/her own record and an MBR confirms it.

    3. 3. 

      The standard display of MEF indicates that a NH has filed for a benefit based on his/her own record.

    4. 4. 

      The MBR shows that a claim was filed.

    5. 5. 

      There was a terminated disability claim.

    6. 6. 

      A disability claim was denied for lack of insured status.

    7. 7. 

      Consider a scrambled earnings case (including IRS scrambles) to be in “claims” status when:

      1. a. 

        All NH's are or were in monthly benefit status on their own record.

      2. b. 

        Any individual who is or was in benefit status on another NH's earnings record.

      3. c. 

        Any NH who has filed a claim for monthly RSDI benefits. This category includes NH's who filed a claim for monthly RSDI benefits that was disallowed or terminated.

  2. B. 

    Consider the record to be in “non-claims” status where:

    1. 1. 

      There is no indication in the case that a claim was filed.

    2. 2. 

      A query of the MBR shows “No record.”

    3. 3. 

      The individual is receiving an auxiliary benefit (e.g., widow, wife, child) based on another person's earnings record.

    4. 4. 

      The case material shows a completed action of no application (No App).

    5. 5. 

      The individual is receiving or has received SSI or black lung benefits.

    6. 6. 

      A disability claim was denied on medical grounds.
