GN 00506.410 Change in Beneficiary DAA Status

A. Policy

Sections 205(j)(1)(B) and 1631(a)(2)(A)(ii)(II) provides that the specified policies apply if the individual is entitled to title II benefits or eligible for title XVI benefits "by reason of disability" and the individual also has a DAA condition. As explained in DI 90070.060, in order for the "special" policies concerning DAA condition individuals to apply, including the higher representative payee fees, the individual must meet the following three conditions. They must be entitled to disability benefits, must have a DAA "condition", and must be incapable of managing their benefits.

B. Procedure

A beneficiary’s record may change from DI to AI or DIB to RIB upon attainment of age 65. Therefore, the payee should stop collecting the higher DAA fee the month the beneficiary attains age 65 and there’s a change in the factors of entitlement.

FO’s should use the SSI redetermination process and site reviews to determine age 65 attainment. Inform the beneficiary and the payee of this change in fee amounts using the notice provided in NL 00703.774 Representative Payee — Change in Authorized Fee — Notice to Beneficiary or Person Standing in Place of Beneficiary .
