GN 03106.015 Notice of Significant Litigation to Assistant Regional Commissioner, Management, Operations and Support (ARC-MOS)

A. PROCEDURE - OALC or OPL

The OALC or OPL will advise the ARC-MOS or other designated component or OCO, the Special Appeals and Examining Section (SAES) of any significant civil actions that arise. A significant civil action is a:

  • Threatened or certified class action;

  • Constitutional challenge;

  • Policy, regulatory or statutory challenge; or

  • Case that has the potential for significant adverse effects on SSA.

B. PROCEDURE - OCO SPECIAL APPEALS AND EXAMINING SECTION (SAES)

If an adverse order is issued against SSA in a case that is the jurisdiction of PC7, OALC or OPL will work with OCO, SAES to insure prompt compliance with the implementation requirements of the court order.

C. PROCEDURE - ARC-MOS

The ARC-MOS or other designated component will notify the FOs, PCs and affected regional component(s) of the commencement of significant civil actions instituted by claimants in their service areas. If an adverse order is issued against SSA that is not appealed, other than cases that are the jurisdiction of PCs, the designated regional component will act as liaison between OALC, FOs, PCs and regional component(s) to insure prompt compliance with implementation requirements of the court order.
