RS 02805.015 Disposition of Requests for Expedited Payment

Technically, there can be no denial of a request for expedited payment and no right of reconsideration attached to request for expedited payments. (The claimant may, of course, pursue appeal rights if there is a disagreement with the initial determination made on the claim or request for resumption of payment.)

Disposition of requests for expedited payments must be made within 15 days of the effective date under one of the methods described below:

1. A. 

   Payment under the normal procedures, including payment under the regular nonreceipt or partial payment provisions.

2. B. 

   Payment made in accordance with the expedited payment procedures.

3. C. 

   Disallowance (or a finding that payment is not due).

4. D. 

   A finding that the expedited payment provision does not apply (i.e., disability payments, or a negotiated check involved).
