DI 26510.030 Completing Item 19 (Claimant Not Disabled) on the SSA-831

A. Disability Insurance Benefits (DIB)

1. Block A – (Through date of current determination)

Check block A when:

  • A DIB or Freeze case in which the insured status expires after the date of adjudication and disability/blindness is not established through the date of the current determination; Or

  • A Closed Period case in which the period of disability ends earlier than the 14th month before the month of filing.

NOTE: The Disability Examiner (DE) will also enter the determination for the closed period in the rationale of the DIB denial on the SSA-831 or on an SSA-4268-U5. The claimant must receive a personalized notice. The notice should include personalized language regarding why extension of the 14-month period for filing for a period of disability cannot be granted.

2. Block B – Through (insert appropriate date)

  • Check this block in DIB or Freeze cases where the date that insured status is last met before the date of the current determination, and the individual is found not disabled on or before the date last insured.

  • Enter the date the earnings requirement is last met.

NOTE: When the field office (FO) receives the earnings record and finds that the Quarters of Coverage requirement is last met in the past, the FO will contact the Disability Determination Services (DDS) and furnish the date last insured.

B. Disabled Widow(er) Benefits (DWB)

1. Block A – Through date of current determination

Check this block in DWB cases where the prescribed period requirement expires after the date of adjudication and disability is not established through the date of the current determination.

NOTE: The prescribed period entry (date last met) can be found in item 6 of the SSA-3367.

2. Block B – Through (insert appropriate date)

  • Check this block in DWB cases where the individual is found not disabled on or before the date that the prescribed period requirement is last met and such date is before the date of the current determination.

  • Enter the ending date of the prescribed period.

C. DWB Medicare only

Check block B in DWB Medicare-only cases when:

  • the evidence establishes that the onset of disability was at age 62 years and 7 months or later.

  • AOD is at age 62 and 7 months or later and there is no reason to question the allegation of the onset of disability.

NOTE: Since a disabled widow(er) must be disabled for 29 months (which includes the waiting period plus the assumed 24 months entitlement to disability benefits) before the individual can become entitled to hospital insurance benefits, there is no need to make a disability determination through the current date, if a disability is alleged at or after age 62 years and 7 months. The disabled widow(er) will automatically become entitled to hospital insurance benefits upon attainment of age 65 regardless of whether or not she/he is disabled. In both of the above situations, insert “Age 62 years and 7 months.” If your legacy system does not allow insertion of this comment in Item 19B, go to Item 34 (Remarks), enter Item number, and add the comment there.

D. Childhood Disability Benefits (CDB)

Check the box in block C in all CDB cases except a re-entitlement claim.

E. CDB Re-entitlement

1. Block A

Check this block in CDB re-entitlement claims when the individual's impairment is not disabling and the re-entitlement period has not expired.

NOTE: The FO will identify subsequent childhood disability benefit claims by entering “Re-entitlement CDB Claims” in item 11. It will also show the beginning and ending dates of the re-entitlement period.

2. Block B

Check this block in a CDB re-entitlement claim when the evidence establishes that the individual was not disabled before the end of the re-entitlement period and the re-entitlement period has expired. Enter the last day of the re-entitlement period.

F. Parent claim

Check the box in block B in a parent's disability determination when the evidence establishes that the parent was not disabled at the appropriate specified point. Enter the date here. (For complete instructions on Parent claims, see Parent Claim to Entitle Dependent Grandchild, DI 23505.005.)

G. Title XVI

Check the box in block A in all cases when a disability is not established. Also check this block when disability ceased prior to the month of filing or prior to 1/74. If the FO or DDS had entered a date in Item 15 for a presumptive disability, and the SSA-831 is paper, draw a line through the checkbox and the check in item 15.
