DI 80830.070 Special Situations – Office of Disability and Adjudication Review (ODAR) Reversals

A. Background

Hearing Offices (HO) now use the Case Processing and Management System (CPMS) to track and route their cases electronically. CPMS, in conjunction with the electronic folder (EF), will contain enough information for Processing Center (PC) technicians and examiners to effectuate the Administrative Law Judge’s (ALJ's) decision.

B. Receipt and Routing – Administrative Law Judge (ALJ) Reversal/or Later Appeals Council (AC) Favorable Decision

ALJ reversals and favorable AC decisions will be routed electronically to the servicing PC via CPMS.

  • In the certified electronic process, an electronic “stub record” will be produced in the Paperless Processing Center (PPC) system with the appropriate TOEL combination (APPEAL/HEARING CPMS REVERSL for PC 1-6 and 8; APPEAL/DHEAR CPMS REVERSL for PC7).

  • A second ACR will also be automatically produced in the site’s PPC for the corresponding attorney fee agreement action if applicable. The assigned TOEL will be ATFEE/FEEPAY.

  • The two ACRs should move together until the claim is completely processed.

  • Once the claim is processed to payment, the “stub record” will be moved to Files In (FIN), and the ATFEE ACR will continue on its way until all attorney fee issues are resolved.

C. Examiner/Authorizer Actions

The technician will examine the case information in CPMS, eView and other electronic resources available and determine whether the case can be effectuated as written by the ALJ or AC.

If the case can be effectuated, the technician will prepare the SSA-831 and, in some sites, any necessary instructions for module processing.

These instructions should be added to the PPC ACR “stub record”, the technician should make sure that the ACR is coded for long-term retention, and in some sites, route it to the module technician for processing.

In addition to the steps above, the technician will fax the completed SSA-831 for inclusion in the EF, using the procedures in DI 80830.100.
