SI KC00520.800 Facility Determinations for Kansas Institutions for Mental Disease (TN 1 - 06/2003)

A. Background

The Center for Medicare and Medicaid Services (CMS) does not allow Medicaid payments for individuals ages 22 through 64 who reside in facilities designated as Institutions for Mental Disease (IMD). The CMS policy is based on the law and regulations (42 CFR 435.1008 and 42 CFR 435.1009.)

The following facilities in Kansas are designated as IMDs:

The Kansas Department of Social Services (SRS) may provide state funding for IMD placements for individuals ages 22 through 64. SRS funding is considered a medical/social service as defined in SI 00815.050 and would not be counted as income to the individual. Because Medicaid does not pay over 50% of the care for individuals in this category, the FBR (less any countable income) is payable.

B. Field Office Procedure

Servicing field offices have included documentation of IMD status on SSA-8045s for the facilities listed in Section A. above. Individuals ages 22 through 64 are eligible for the full FBR (less any countable income) effective July, 2003.

The Regional Office will notify the servicing field offices when further information is available from SRS on state funding for periods before July, 2003.
