SI 01110.003 Resources limits for SSI benefits

A. Policy principles

1. Excess resources cause ineligibility

An individual (or couple) with countable resources in excess of the statutory limit is not eligible for Federal SSI or federally- administered State supplementary payments. However, conditional benefits provisions may apply see SI 01150.200.

3. Change in marital status

A change in marital status will result in a change to the applicable resource limit. The resource limit change is effective with the month that we begin treating both members of a couple as individuals, or vice versa.

For example, separation from a spouse will reduce the limit from $3,000 to $2,000. Refer to our policy for the spouse of adult individuals SI 01110.530 B.

1. Individual with spouse

To determine whether an individual has a spouse, either eligible or ineligible, and so qualifies for a higher resource limit, see SI 00501.150.

2. Special limits for certain converted recipients

Certain converted recipients may qualify for additional resource exclusions or higher limits, depending on the provisions of the applicable State plan under which they received assistance prior to 1974, see SI 01220.001.

3. Waiver when countable resources exceed the limit by$50 or less

Waiver provisions for recovery of overpayments due solely to excess resources of no more than $50 may apply, see SI 02260.035.
