GN 01722.011 How the Spanish Agencies Develop Applications

A. Introduction

The central and local offices of the ISM and the provincial offices of the INSS take claims from individuals who want to file for benefits under the agreement. These agencies send some of the claims material to the FSP in Madrid and some of the material to OIO.

B. Process

The following section contains a description of the applications and evidence obtained by the Spanish agency offices and forwarded to the FSP and OIO.

1. U.S. Claim

If the claimant contacts an ISM or INSS office to apply for U.S. benefits, the agency obtains form USA/E2 (Statement of Intent to File for U.S. Benefits). The form is forwarded to the FSP, Madrid for claims development.

The Spanish agency prepares and forwards the following material to OIO:

  • Liaison form E/USA 3, certifying the filing date.

  • Spanish coverage record.

  • Available medical evidence if the claim is for disability benefits.

2. Spanish Claim

If the Spanish agency needs a U.S. coverage record and/or entitlement data to complete the Spanish claim, the agency requests the information from OIO using form E/USA 3.

3. U.S. and Spanish Claim

If the claimant contacts an ISM or INSS office to apply for both U.S. and Spanish benefits, the agency obtains the required Spanish forms and form USA/ E2 (Statement of Intent to File for U.S. Benefits). Form USA/E2 is forwarded to the FSP, Madrid for claims development.

The Spanish agency prepares and forwards the following material to OIO:

  • Liaison form E/USA 3, certifying the filing date and requesting a U.S. coverage record and/or entitlement data if it is needed.

  • Spanish coverage record.

  • Available medical evidence if the claim is for disability benefits.
