GN 02608.105 Exemption Due to Pension Eligibility Before July 1983 and One-Half Support Met

NOTE: This POMS section applies to months of entitlement prior to January 2024 only. The Social Security Fairness Act (SSFA) of 2023 eliminated the reduction of Social Security benefits under GPO as of January 2024. For more information, see GN 02608.100.

A. Eligible or entitled to pension before July 1983

GPO does not apply to benefits payable for December 1982 and later, if the spouse:

  • is eligible for or entitled to a government pension before July 1, 1983 (If pension eligibility began in June 1983, see GN 02608.106), and

  • meets the one-half support requirement. For an explanation of the one-half support requirement, see RS 01301.010 and RS 01301.015.

B. Proofs for exemption

Obtain the following documentation before applying the exemption:

  • evidence of one-half support (both men and women), and

  • evidence of pension eligibility or entitlement before July 1983 from the employer or pension paying agency.

You may use Civil Service Annuity (CSA) numbers as evidence of pension eligibility. For more information on CSA numbers, see GN 02608.100C.5.
