The Disability Determination Services (DDS) prepares and releases a personalized notice for affirmations of initial denials. The notice consists of a preprinted form notice SSA-L1130-U2- (Supplemental Security Income Notice of Reconsideration – Disability) and a personalized explanation. (See DI 27025.020 for preparation of the personalized explanation.) In concurrent Title II/Title XVI claims, include paragraph 841 in the Title XVI notice when the SSA-L1130-U2 is not preprinted. If a reconsideration request on a partially favorable determination is a denial, prepare a reconsideration denial notice. Since the initial determination is under appeal and is not final, this is considered a reconsideration, and not an adverse reopening.
