   DI 40515.025 Allegations of Improper or No Due Process
   
   
   
   
      - 
         
            • 
               Review the folder/electronic file/record and other repositories of notice documentation,
                  including the Online Retrieval System (ORS), when there is an allegation of improper
                  or no due process.
                
 
 
- 
         
            • 
               When the folder/electronic file/record confirms that benefits were suspended or terminated
                  without proper due process:
                
                  - 
                     
                        a.  
                           Reinstate benefits from the date of the original suspension or termination action; 
 
 
- 
                     
                        b.  
                           Continue benefits until due process is provided; and 
 
 
- 
                     
                        c.  
                           Return the folder either to the Disability Determination Services for remedial due
                              process notice action or to the field office after reinstatement.
