HA 01450.020 Request for Reconsideration of the Appeals Council's Response to a Request for Voluntary Remand

If the Office of the General Counsel (OGC) disagrees with the Appeals Council's denial of a request for voluntary remand, it may request reconsideration from the Appeals Council (AC). Two members of the AC, including the Division Chief Administrative Appeals Judge, will review the case upon receipt of the request and will promptly notify OGC of any change to the AC's prior position on the case.

If OGC continues to have concerns with the AC's position regarding the defense of a pending court case, OGC may contact the Office of Appellate Operations Executive Director's Office.
