The Disability Determination Services (DDS) needs the comparison point decision (CPD)
evidence, which is normally in the Title II folder.
DDS does not need the Title XVI file unless the CPD evidence is in that file. The
situations listed in this subsection occur most likely when DDS needs the Title XVI
folder:

In cases converted from State welfare rolls in January 1974, without a Federal disability
determination.

In cases in which we adopted a Title II allowance from an earlier Title XVI allowance.

If there is no Title II entitlement, obtain the Title XVI folder.

Even if evidence is in the Title II file, DDS will obtain the Title XVI file if they need the State plan CPD.
