DI 39542.015 Contract Proposals Not Requiring DA Approval

A. Operating policy - new contracts

The State is not required to obtain Disability Adjudication (DA) approval (unless the State is receiving TMA) of plans to contract for personnel management or administrative functions which do not involve disclosure of SSA claimant information to the private sector. These include contracts for:

  • in-house medical consultants;

  • building services and equipment maintenance;

  • services provided by other agencies of the State;

  • functions, services, or purposes that do not concern SSA in terms of charges to the SSA/DDS budget, e.g., for non-SSA work such as processing claims for a State teachers' disability program or Medicaid.

B. Operating policy - renewal contracts

The State is not required to obtain DA approval if the renewal contract does not substantially change the requirements of the prior contract that was:

  • in force at the time these instructions are published, or

  • based on an RFP, which was initially approved by DA.
