HI 00630.060 SMI Terminations and Withdrawals - General
Terminations and cancellations of terminations made through the United States mail
will be considered filed when postmarked, if the date is pertinent. Thus, when a request
is received through the mail early in the month following the end of a calendar quarter,
the envelope containing the U.S. postmark should be retained until the writing is
finally processed. If the postmark is illegible or the envelope has been lost, it
will be presumed that a writing received in the first 7 days of the quarter was mailed
during the preceding calendar quarter, unless there is some evidence to the contrary;
e.g., the statement bears a date indicating it was prepared in the same quarter it
was received. Where the writing was mailed in a foreign country, the date of receipt
will be considered the date of filing. If material, the date the writing entered the
U.S. postal system, usually shown by the U.S. postmark, will be used.
All termination requests and cancellation of termination requests will be processed
by the modules.
