RM 10211.265 Evidence of Employment Authorized Immigration Status for an M1 (Foreign Student) for an SSN

All M1 students are only authorized to work when DHS has issued an EAD (I-766). In the rare situation when the requirements for a non-work SSN are met, an M1 student must submit evidence of nonimmigrant status per RM 10211.135 and Form I-20 (Certificate of Eligibility for Nonimmigrant Student Status) as evidence of immigration status

A. Evidence of employment authorization for an M1

All M1 students, including M1 border commuter students, must submit an Employment Authorization Document (EAD) as evidence of employment authorized immigration status.

B. Background information on evidence for an M1

The M-1 nonimmigrant alien classification is for foreign students pursuing a full course of study in DHS-approved vocational and nonacademic schools in the U.S.

An M1 student may only work in Optional Practical Training (OPT) for which the M1 student has an EAD from DHS. (M1 English-language-program students are ineligible for optional practical training.)

M1 students cannot work in general on-campus employment, Curricular Practical Training, internship with international organization nor due to severe economic hardship, thus will not be issued an EAD for any of this type of work.
