RS 00605.540 Recomputation to Include RR Compensation in Survivor Cases - Policy

Policy

When SSA has jurisdiction of a survivor claim, RR compensation not previously considered wages while the NH was alive is added to the ER and used in computing survivor benefits if the following requirements are met:

  • NH died after 1967; and

  • NH was entitled to a RIB or DIB; and

  • SSA has jurisdiction of any survivor claim.

If the PIA is a 1977 amendment or later PIA , the increase must be at least $1.00.

NOTE: The 1967 OS PIA is available for use in the RR recomputation even if there are no earnings after 1965. The 1990 OS can only be used if some of the earnings are after 1992. The 1967 OS could still apply if the RR earnings are for earlier years and the other requirements are met.
