RS 01602.305 Claimant Alleges No Railroad Retirement (RR) Service but Earnings Record (E/R) Shows RR Earnings

If your review of the Earnings Record identifies RR service but the claimant alleges no RR earnings:

Number holder (NH) alleges no RR earnings, and

E/R shows RR earnings, and

RR earnings not used to establish insured status or primary insurance amount (PIA) or

Tolerance rule applies RS 00601.010

Take no further action regarding RR earnings

NH alleges no RR earnings, and

RR earnings used for insured status, or

RR earnings used in PIA computation

Contact claimant to resolve.

 

Consider developing for scrambled earnings, using RS 01602.350 in this section.

NH agrees with E/R after they receive an explanation of the posted earnings

Record NH’s confirmation on a Report of Contact (RPOC) screen following instructions in MSOM MCS 008.007. You need to take no other action on the discrepancy.

Dual postings of identical RR and SS earnings amounts are present, you could use the year(s) in a computation for any benefits, and use of the duplicate RR earnings could increase the benefit payable.

Forward claim to the processing center as a partial award, excluding the duplicate RR earnings.

 

Include annotation in Remarks that the PC needs to develop duplicate wages, according to RS 01602.350 in this section.

NH insists that they had no RR earnings, and earnings posted as RR earnings are necessary for insured status or could increase the PIA.

Process the claim as a partial award, using an A101 to forward the claim to the PC for adjudication.

Do not include the RR earnings if the NH is insured without the disputed earnings.

Request PC contact with the RRB to confirm the name of the RR employer and dates of employment, and develop according to RS 01602.350 in this section.

NH agrees with SSA and RRB, after receiving additional information from the RRB on the employment in question.

Process the claim to an award or a denial, depending on the information received from the RRB.

NH disagrees with SSA and RRB, and claims that they did not work for the employer and did not earn the posted wages.

Process the claim as an award or denial without including the disputed earnings.

 

Clear with an A101.
