RS 01901.380 Coverage Determinations – Service for Federal Government and Federal Instrumentalities

CITATIONS:

Section 205(p) of the Social Security Act.

A. POLICY

Except for service beginning on or after 11/10/88, SSA has no authority to determine whether employment for a Federal agency or instrumentality is covered. That authority belongs to the head of the employing agency.

B. PROCEDURE -- FIELD OFFICES (INCLUDES OCO)

  1. 1. 

    Annotate the record if an individual claims wage credits for service before 1984, and explain that credit cannot be given.

  2. 2. 

    If uncertain, accept available evidence regarding the period of employment, type of appointment, place of employment, and whether deductions were made for contributions to a retirement system.

  3. 3. 

    Refer the issue to the RO (OCO to Central Program Staff (CPS)) if a determination that services are not covered cannot be made. The FO may consult the RO before obtaining evidence.
