RS 02201.034 Relationship Between Statute of Limitations and Rules of Administrative Finality

POLICY

A final determination relating to revision of an E/R may be reopened under the conditions described in GN 04040.030.

A final determination for an application for benefits may be reopened pursuant to GN 04001.060; but the determination related to the E/R may not be reopened because the conditions in GN 04020.010 ff. for reopening that determination are not met; or

An earnings determination which has become final may be reopened pursuant to GN 04030.050 but the determination on the application for benefits may not be reopened. The effect on the PIA of the revised earnings determination, and the resultant increase in the benefit amount payable, is effective with the month the question was raised which resulted in a revision to the previous earnings determination. See GN 04040.030B.
