Federal judges, including the Chief Justice and Associate Justices of the U.S. Supreme Court may, at their discretion, retire at full salary at age 70 after 10 years of service, or at age 65 after 15 years of service.

Justices or judges may also retire at age 70 with less than 10 years of service, or at 65 with less than 15 years of service, and receive one-half of their full salary.

Such retired judges, or justices may, at their option, “take senior status” and continue to assume as much of the judicial workload as they care to assume and the court wishes to assign them.

Payments to retired Federal judges for services performed after retirement are not wages; therefore do not count for ET purposes, payments to retired Federal judges for services performed after retirement.
