RS 02807.025 Disposition of Form SSA-1877

The DO/BO will review the ONBE or MBR to assure that both the applicability and minimum evidence requirements for preliminary payments have been met. Technically, there can be no refusal to accept a request for preliminary payment and no right of reconsideration attaches to such a request. Disposition of any request for preliminary payment must be made within 15 days from the date of the request using one of the methods below:

  1. A. 

    Payment made in accordance with the preliminary payment procedure.

  2. B. 

    A finding that the preliminary payment provisions do not apply under section 205(q) (e.g., disability payments, lump sum death payments). See RS 02807.005.

  3. C. 

    A finding that the filing and minimum evidence requirements are not met to enable preliminary payments while the evidence for a final determination is being secured.
