DI 23022.075 Appeals Processing of Compassionate Allowances (CAL) Cases

There is no systems notification when the field office (FO) transmits the appeal of an initial claim previously identified as a CAL case.

A. Initial claim was not CAL and the Disability Determination Services (DDS) identifies CAL at the reconsideration level

If the DDS identifies a CAL condition at the reconsideration level, manually update the case to CAL: Y (refer to adding a case to CAL processing in DI 23022.055B) and process using expedited procedures.

It may be appropriate to manually update the case even when the CAL condition was present at the initial level. Use judgment and consider the issues in DI 23022.055E to decide whether to again identify the case for CAL processing.

B. Request for review at Appeals Council and claimant files a subsequent claim on CAL case
