DI 41005.030 Redeterminations for Statutory Blindness Cases

RS 00301.160, last paragraph, describes the circumstances under which a statutorily blind WE entitled to DIB for months before 1/73 can have their period of disability redetermined based on the fully insured status requirement based on a new application. DO's will route such applications to ODO/PSC-DRS/INTPSC by a route slip with the remark “For redetermination—RS 00301.160.”

A. Period of disability previously established as of the date of onset of statutory blindness

If the period of disability was previously established as of the date of onset of statutory blindness, the beneficiary is not entitled to a redetermination. Prepare an SSA-831-U5. Complete only Items 3-5, 7, 9, 12, 27, 29, 37 and 38. On an SSA-4268-U4, record the fact that the beneficiary is not entitled to a redetermination. Notify the beneficiary by Model Letter W (see DI 41005.035, Exhibit 15). Destroy all copies of the SSA-831-U5 except the Folder Copy and DO Copy.

B. Period of disability previously established after the date of onset of statutory blindness

Route the case to an authorizer indicating the first date the beneficiary is both statutorily blind and fully insured. Ask the authorizer whether the benefit amount would be increased if the period of disability was established as of the date of onset of statutory blindness or, if later, the date fully insured status is first met. If the authorizer indicates that the benefit amount would be increased, prepare a revised SSA-831-U5 to establish the period of disability as of the date the beneficiary was both statutorily blind and fully insured. If the authorizer indicates that the benefit amount would not be increased, proceed as in A. above.

C. Established period of disability not based on statutory blindness

If the established period of disability was not based on statutory blindness, it is possible that the beneficiary may have since become statutorily blind. Since this date would be later than the beginning date of the established period of disability, the beneficiary is not entitled to a redetermination. In this situation, proceed as in A. above.
