In the Denver Region, all States give legal guardians and conservators the power and
duty to protect the minor's or incompetent person's property and to use the property
for support, care, and education of the individual. As a general rule, a conservatorship
(or "blocked") account is available for the individual's support and maintenance.
Therefore, the account is a resource to the individual, unless there is specific
restrictive language in the court order.
If it is not obvious from the court order that the funds are available as a resource,
contact RSI/SSI Programs at (303) 844- 5717 for instructions. If necessary, you may
be requested to send a copy of the court order to the Regional Office for an opinion
by the Chief Counsel.
