Where only one person, either the eligible individual or the eligible spouse, meets the conditions specified in SI 01220.100 and that person dies after December 1973, only the SSI Federal resource limits and exclusions will be applied for the now eligible individual.

Where a recipient who meets the conditions in SI 01220.100 is divorced or is living apart for more than 6 months from an eligible spouse who does not meet the requirements of SI 01220.100, the spouse or previous spouse not meeting those requirements may not have the State plan resource limits and exclusions applied. However, if both the eligible individual and the divorced or separated spouse meet the conditions in SI 01220.100, the State plan resource limits and exclusions continue to apply.
