SI 01320.155 Deeming - Payments Based on Age and Residence - Policy Principle

Authority: Regulations 20 CFR 416.1161(a)(12), (b), (d)

Periodic payments made by a State under a program established before July 1, 1973, based solely on duration of residence and attainment of age 65 are not included as income available for deeming to a child or spouse. Such payments received by an eligible alien are not used to reduce the allocation. (The payments do not apply to ineligible children.) These payments are included as income to an essential person or a sponsor of an alien. The only program under this provision is the Alaska Longevity Bonus (ALB) program.
