SI DEN01415.011 State Supplementation Payments In South Dakota

A. Mandatory Supplementation Payments

SSA administers the State's mandatory supplementary payments. The payment amount is determined by the minimum income level (MIL) established at the time of conversion in 1973 and increased by the cost-of-living adjustments (COLAs).

B. Optional Supplementation Payments

The State administers its optional supplementary payments - South Dakota Senate Bill 201, effective 2/75 and South Dakota Senate Bill 32, effective 7/78.

Individuals in licensed adult foster homes - maximum State payment for 1995 is $645; 1994 is $621; 1993 $591. Currently individuals in licensed assisted living facilities - maximum payment level for 1995 is $755; 1994 - $727; 1993 - $692.

Only those individuals and couples on the SDX who are in LA A or B and in current pay status who have no other income. An individual will receive $15 per month and each member of a couple will receive $8 and $7 respectively.

Resident of State or residing in an out-of State facility because space is not available in or near their home community.

7. Eligibility

All residents of licensed adult foster homes or personal care facilities are in noninstitutional care facilities and LA A applies. This satisfies the requirements in SI 00835.790.

The State approves and licenses facilities. FOs are not responsible for determining the need for residency in these homes. The county DSS makes placement and completes certification.

Payment will be certified based on the SSI SDX file.

Optional supplementation for the individual begins with the date of confinement if financial eligibility can be established on that date but retroactive eligibility can be established on that date but retroactive eligibility cannot be established for more than 3 months prior to the month of application.

SSI recipients will be eligible with the first month they appear on the SDX file. There will be retroactive payments if requested by the recipient. The State will first use the SDX as proof of SSI eligibility in a prior month(s) or will accept the SSI award notice. A contact with the FO will be initiated as a last resort. No retroactive payments will be made for any month prior to the first month of the current fiscal year, July 1.

There are no income or resource exclusions.

SSI exclusions also apply to optional supplementary payments.

No applications are necessary for current SSI beneficiaries. Use DSS form CP-561 for applicants who would be eligible for SSI and optional supplementation only.

No application is necessary for the payment since they are automatic based on the SDX.

9. Termination

Eligibility ceases when the individual no longer requires long term care in either type of facility.

Eligibility ceases if the individual no longer receives SSI payments, receives other income in addition to SSI, is institutionalized, or dies.

C. Other Information - Senate Bill 201 Payments Only

1. Personal Care Environments

Personal care environments are certified adult foster home or supervised personal care facilities which meet State licensing or certification requirements.

2. Request for Certification or Verification of Continuing Eligibility

If the FO is informed that an individual is in need of or may be eligible for optional supplementary payments, referral should be made to the nearest local DSS office. The FO will be advised by the DSW caseworker of all placements, addresses and representative payee changes needed in a care record.
