1. Individual - No Month of Ineligibility in Quarter

 

Example:

 

Joe Flake, an eligible individual, lived alone in his own household. On August 5, 1981, he moves into his daugh­ter's household. He remains there throughout the remain­der of August and September. He receives social security benefits of $150 per month. He makes no contribution to the daughter's household expenses. His payment for the quarter is computed as follows:

2. Couple - No Month of ineligibility in Quarter

 

Example 1:

Ralph and Lois McNulty, an aged couple, are living in the household of another and receiving support and maintenance. On August 21,1981they move into an apartment where they pay all their own bills. Ralph and Lois receive no income other than their monthly SSI checks. Ralph and Lois choose not to rebut the presumed value of the in-kind support and mainte­nance received for the 21 days in August ($152.33). Their payment for the quarter is computed as follows:

Example 2:

John and Mary Snip, an aged couple, have been living in their own household. John receives unearned income of $50 a month. On July 23, 1981, they both go to a medical facility where Medicaid pays for all the costs. The compu­tation for the third quarter of 1981 is:

Throughout the fourth quarter of 1981 each member of the couple would continue to be due $10 per month. Ef­fective January 1982 it is necessary to determine whether the couple is living together in the same room in the facili­ty. If they were not living together, the computation for the first quarter of 1982 would follow the rules in SI 02009.025. Beginning in January, Mary would be due $25 a month and John would no longer be eligible since his countable income ($30/month) exceeds the monthly FBR of $25.

3. Individual - Month of Ineligibility in the Quarter

Example 1:

Mr. Charles Carlson, an aged individual, was living alone in his own home until August 18, 1981 when he was rushed to the VA hospital for treatment. The VA hospital is a public institution receiving Medicaid payments on his behalf. He was ineligible for September. He re­mained in the hospital until October 5.1981, when he re­turned home. He had earned income of $150 in the September quarter and unearned income of $600 result­ing in countable income of $540 ($180 per month) for the quarter. The computation of the payment amount is:

Example 2:

Mrs. Joan Johnson, a widow, had been receiving SSI pay­ments of $124.70 a month and title II benefit of $160 a month. On August 14, 1981 she died. Her total income for the quarter was $320, resulting in countable income of $260. The computation for the quarter is:

Since there is no eligible spouse, no interim assistance re­imbursement nor any unresolved overpayment in this case, there is no payment of the additional $53.14 (the difference between the SSI payments received and due) for each of the months of July and August.

4. Eligible Couple - Month of Ineligibility in the Quarter

Example:

Fiacro and Maria Ramirez are an aged couple living in their own household. Fiacro receives $135 per month title II benefits. This is the couple's only income other than their SSI payment. On August 10, 1981 they go to Mexico to live with Maria's sister. They remain there throughout August and September. It is determined that they are not receiving in-kind support and maintenance in Mexico. It is also determined that the move is not a temporary ab­sence. The computation of the payment amount is:

The non-excludable income received during months of ineligibility must be counted along with the income re­ceived during months of eligibility in computing the SSI payment amount for the quarter in which the change occurs. Where one member of an eligible couple becomes ineli­gible for 1 or 2 months of a quarter, (e.g.. due to death, in­stitutionalization, or being outside the U.S.). The remaining member of the couple assumes the same status as an eligible individual with an ineligible spouse for such months. The payment for these months is computed by applying the rules in SI 02009.025.
