HI 00805.020 Determining the IEP for Aged Alien Non-Beneficiaries

A. Policy

An alien age 65 or over who is not eligible for monthly title II benefits must meet the residence/alien-status requirements in HI 00805.005 A. 2.

The IEP for such an individual begins with the first day of the 58th full month of continuous residence in the U.S. and continues for a total of 7 months.

Where the 5 year residence requirement is completed before the individual receives notice that the individual is lawfully admitted for permanent residence, the month of receipt of the permanent residence notice is the 4th month of the IEP.

B. Example

1. Residence begins after first day of month

Mark Lopez, an alien lawfully admitted for permanent residence, began residing in the U.S. on 2/15/87. Since Mark meets the 5 year residence requirement as of 3/1/92, this is Mark's first month of SMI eligibility. Mark IEP consists of the 7 months 12/1/91 - 6/30/92.

2. Residence begins on first day of month

If Mark Lopez had entered the U.S. on 2/1/87, Mark would meet the 5 year requirement as of the 5th anniversary of Mark's entry date. Mark would be eligible for SMI as of 2/1/92 and Mark's IEP would consist of the 7 months 11/1/91 - 5/31/92.
