HI 01001.110 Collection from Individual Entitled under Both SS Act and RR Act

A. General

When an enrollee not covered under a State buy-in agreement is entitled to both an SS benefit and an RR annuity or pension, premiums for SMI coverage are collected by RRB.

When an RSDI beneficiary, entitled to Medicare benefits, becomes entitled to an RRB annuity, RRB establishes a health insurance record under the RRB claim number and notifies SSA. BSS transfers the health insurance utilization from the SSA claim number to the RRB claim number and notifies RRB of the last month for which SSA collected SMI premiums. If the QRRB is presently entitled to SMI and is not having their premiums paid under a State buy-in arrangement, SSA notifies them of the change in jurisdiction by use of an HCFA-L 623, “Notice Regarding Collection of Medicare Premiums.”

B. Dual Premium Deductions

When it is brought to the DO's attention that both SSA and RRB have collected SMI premiums for the same period, prepare a memorandum addressed to the Railroad Retirement Board, 844 Rush Street, Chicago, IL 60611.

The subject is “Dual SSA and RRB SMI Premium Deductions.”

In the text of the memorandum state the problem, i.e., SSA and RRB have both withheld SMI premium since        . Attach any evidence received from the enrollee.

Notify the enrollee that their request has been referred to RRB for necessary action and reply.

When the amount of the refund is obtained by RRB through the initial electronic screening process, RRB makes the refund. After RRB has made the initial screening and it later becomes aware that SSA and RRB have collected SMI premiums for the same period, RRB rescreens through the electronic screening process. Usually in the rescreening process, SSA will make the refund to the beneficiary; however, RRB makes the determination as to which agency makes the refund.
