A. EXHIBIT LETTER

We are writing to you about court order number (1) . We plan to take out (2) of (3) monthly Social Security payments to satisfy your court order. Although we have started withholding this amount, we will not pay it out until we know whether (4) is supporting a second family. We should have this information within 45 days.

The Consumer Credit Protection Act limits the amount we can take out of a person's Social Security payment for child support and/or alimony (15 U.S.C. Section 1673). The amount depends on whether the person is supporting a spouse and/or dependent child(ren) other than those whose support has been ordered:

  • If yes, we may take out up to 50 percent.

  • If no, we may take out up to 60 percent.

The above rates increase 5 percent to 55 percent and 65 percent if the person owes more than 12 weeks in back payments.

B. REQUESTING INSTRUCTIONS

  • This letter will be sent to advise the court that we are withholding the amount requested (assuming it's not more than the CCPA or State limit) while we are waiting for the beneficiary to tell us whether he/she is supporting a second family.
